Terms of Use (TOGA EFB)

The App is a tool that supports flight study and preparation. It is not a navigation device, and it does not replace official aeronautical information (AIP, NOTAMs) or paper charts. Decisions about the flight, and responsibility for them, rest with the pilot in command. Please read the notice at the top of these Terms.

If you fly under rules that require approval to use an electronic flight bag or electronic charts (for example, as part of an air operator or flight school), obtaining and following that approval is your responsibility.

① Charts are copies of the original AIP documents published by Japan's Civil Aviation Bureau (MLIT) and Taiwan's Civil Aeronautics Administration (MOTC), and instrument procedure charts published by the U.S. Federal Aviation Administration (d-TPP, which the App downloads directly from the FAA). They are shown with their effective dates. Before an actual flight, always check the latest AIP and NOTAMs.

② Your position on charts, approach paths on the map and nearby-traffic information are for reference only. They may differ from reality because of GPS or network conditions or data errors.

③ Airport, airspace, airway and navaid data are compiled from public sources. We do not guarantee that they are accurate or current.

④ Weather, NOTAMs and other information come from public sources such as NOAA (aviationweather.gov), the Korea Meteorological Administration, Korea's MOLIT and Japan's SWIM service, and the App shows their source. They may be delayed or incomplete, and copies saved for offline use may be out of date. Notices that a source requires us to show (for example, that data may not be the latest) form part of these Terms.

⑤ Japan ATIS (where available): under the terms of Japan's SWIM service, ATIS is shown only to signed-in users who confirm that they are air-traffic related personnel (pilot, student pilot, instructor, dispatcher or other air-traffic related person). Please confirm truthfully, and withdraw the confirmation in the App (More › Account) if it no longer applies.

Signing in is optional; without an account, your data stays on your device. You can sign in with Apple, Google, Kakao or email, and your TOGA EFB account is the same as your toga.kr account. Use your account only yourself, and do not share or transfer it to anyone else.

You can delete your account at any time in the App (More › Delete account) or as described at toga.kr/delete-account.

① The “Airport charts subscription” (monthly or annual) is sold through in-app purchase on the App Store or Google Play. Its title, length and price are shown on the purchase screen before you buy. Payment and billing are handled by the store, and we never receive your card details.

② The subscription renews automatically for the same length and price unless you cancel it at least 24 hours before the end of the current period. The renewal is charged within the 24 hours before the period ends.

③ If a free trial (7 days) is offered, it converts to a paid subscription and you are charged unless you cancel at least 24 hours before the trial ends.

④ You can cancel in your store's subscription settings (iPhone/iPad: Settings › your name › Subscriptions; Android: Google Play › Payments & subscriptions › Subscriptions). Deleting the App or your account does not cancel a subscription.

⑤ Refunds are handled under the procedure of the store you paid through (Apple: reportaproblem.apple.com; Google Play: request a refund from your order history). For Google Play purchases you can also contact us at support@toga.kr. This does not affect any rights you have under consumer protection law.

⑥ App subscriptions are separate from paid passes on the toga.kr website and cannot be transferred between them.

You must not access the App or our servers without authorisation or by automated means, interfere with the operation of the Service, redistribute or sell charts or data without permission, share or transfer your account, make a false confirmation (for example, for Japan ATIS), or otherwise breach the law or these Terms.

We may improve, add or change features and data, and we may change or suspend all or part of the Service when necessary for operational or technical reasons. If a change significantly disadvantages paying subscribers, we will tell you in advance.

The App and its data are provided “as is” and “as available”. TO THE EXTENT PERMITTED BY LAW, WE DO NOT WARRANT THAT THE APP OR ITS DATA ARE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED OR FIT FOR NAVIGATION.

To the extent permitted by law, we are not liable for damage caused by errors in what the App displays or in its data, by network failures, by device malfunctions or by similar causes, unless we acted intentionally or with gross negligence. Nothing in these Terms limits rights that cannot be limited under the consumer protection law that applies to you.

If you downloaded the App from the App Store, Apple's Licensed Application End User License Agreement (apple.com/legal/internet-services/itunes/dev/stdeula) also applies to your use of the App. Apple is not a party to these Terms. If you downloaded the App from Google Play, the Google Play Terms of Service apply to your purchase.

These Terms are governed by the laws of the Republic of Korea. This does not prevent the application of mandatory consumer protection laws of the country where you live.

If we change these Terms, we will post the new version on this page with its effective date.
